Supreme Court Tosses Out Appeal Decision; Upholds Travel Ban
Chalk up another legal victory for the Trump administration.
Right now, President Trump is involved in a litany of litigation because of activist groups around the country. Unfortunately, some of these more frivolous actions have actually gained traction because of activist judges lining the lower courts.
One such court to protest President Trump by wielding their judicial power is an appellate court from Maryland. In a case brought by the American Civil Liberties Union, the Maryland court ruled to block the nationwide travel ban issued by the Trump Administration.
Late on Tuesday night, the Supreme Court threw out the appellate court decision that struck down President Trump’s previous travel ban from major terrorist hotbeds, including: Iran, Libya, Somalia, Sudan, Yemen, and Syria.
In a one-page decision, the court unanimously ruled against the Maryland appellate court and upheld the travel ban.
By now the executive order has already expired and was replaced by a new one. The new travel ban, scheduled to take effect on October 18th, removed Sudan from the ban but added Chad and North Korea and certain government officials from Venezuela.
Earlier this year, the 9th Circuit Court refused to even hear an appeal from the Trump administration regarding upholding their original travel ban. However, when it comes to the Supreme Court it seems the travel ban has so far had few problems.
Tuesday’s reversal was yet another decision from the Supreme Court that sides with the President. Back in June, the Supreme Court reinstated significant elements of the travel ban that lower courts initially blocked. Back in September, Justice Anthony Kennedy temporarily blocked another 9th Circuit Court decision that tried to limit President Trump’s travel ban.
It’s no surprise that House Representative Trey Gowdy has stated “[t]he 9th Circuit has a well-earned reputation for being presumptively reversible.”
